Due to the massive use of the internet as a vehicle for the exercise of freedom of expression, resulting in a large number of judicial processes on it in Brazil, and the actual difficulty in implementing effective protection of freedom of expression and at the same time guaranteeing safeguard to other rights that have the same level of constitutional and legal protection, the course objective is to study the current academic and judicial trends on the mentioned subject, nationally and internationally, to assist legal operators in the task of solving the practical problems that have emerged.

The tensions between a robust exercise of freedom of expression and safeguard of the right to privacy, especially in the context of massive data collecting on Internet, has been a matter of intense judicial discussion around the world. The complexity of problems surged from this tension imposes serious difficulties to law operators in identifying the best criteria to deal with them.

Member of Columbia Global Freedom of Expression Juan Manuel Ospina and appellation judge of São Paulo Court of Justice and University of São Paulo professor Marco Fábio Morsello-PhD will discuss how in the Brazilian legal and judicial system, and in different legal systems around the world, the protection of privacy and freedom of expression can coexist in harmony even when they collide.

Moderator: Dr. Claudio Augusto Pedrassi, São Paulo Court of Justice

Dr. Claudio Augusto Pedrassi is a Judge of the Court of Justice of São Paulo, working at the 2nd Chamber of Public Law. He teaches Postgraduate and Magistrate Training courses at the São Paulo School of Judges and Civil Procedural Law at FACAMP. He graduated in Law from the Pontifical Catholic University of Campinas and holds a Master’s degree in Civil Procedural Law from the Pontifical Catholic University of São Paulo.

Juan Manuel Ospina, Columbia Global Freedom of Expression

Juan Manuel has a Master’s degree in Journalism from Universidad de los Andes in Colombia, where he received his Law degree as well. He has taught classes at the university level, and his first book, about public health in Colombia, was published in 2022. Juan Manuel was also Chief Editor at El Uniandino, a leading college newspaper from Bogotá.

Marco Fábio Morsello, São Paulo Court of Justice; São Paulo School of Judges; University of São Paulo

Marco Fábio Morsello holds a Bachelor’s degree (1986), a Doctorate (2004), and a Professorship (2021) from the Faculty of Law of the University of São Paulo. He is currently an Associate Professor of Civil Law at the Faculty of Law of the University of São Paulo and an Assistant Professor at the São Paulo School of Judges. Marco Fábio Morsello is an effective member of the Court of Justice of São Paulo and a Judge of the 12th Chamber of Private Law of the Court of Justice of the State of São Paulo. He works mainly on the following topics: civil liability, air transport, maritime law, transport law, contracts, property law, and family law.
